These Terms of Service (“Terms”) govern your use of the Permit Prep mobile applications, including but not limited to CA DMV Permit Prep, FL Class E Exam Prep, and any future state-specific permit preparation applications (collectively, the “App”) operated by Prat City LLC DBA Traffic Safety Institute (“TSI”, “we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 15 years old to use this App. By using the App, you represent and warrant that:
- You are at least 15 years of age
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
If you are under 18, you should review these Terms with a parent or guardian.
2. License to Use the App
Subject to your compliance with these Terms, TSI grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use in preparing for your state’s driver permit or license examination.
The App provides educational content specific to the state indicated by the particular application you have downloaded (e.g., CA DMV Permit Prep for California, FL Class E Exam Prep for Florida).
Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, sell, or sublicense the App
- Remove or alter any proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Share your account credentials with others
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems (bots, scrapers) to access the App
- Share, distribute, or reproduce any test questions, answers, or explanations from the App
3. Account Creation
Optional Account
The core study features of the App do not require an account. You may use practice quizzes, study modes, and track local progress without registration.
Required for Social Features
To access leaderboard, challenges, and social features, you must create an account using Apple Sign-In. When creating an account, you must:
- Provide accurate and complete information
- Choose a username that is not offensive, impersonating, or infringing
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use
You are responsible for all activities under your account.
4. Subscriptions and Payments
Free Features
The App offers limited free access including:
- Up to three (3) practice tests per week
- Limited specialty questions per week (e.g., Road Signs)
- One (1) diagnostic assessment
- Basic study features
Free tier usage limits reset on a weekly basis. We reserve the right to modify free tier limits at any time.
Premium Plans
We offer three Premium options that unlock all features and remove free tier limitations:
- Weekly Premium: $7.99 per week, auto-renewing. New subscribers receive a three (3) day free trial. You will not be charged during the free trial period. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid weekly subscription at $7.99 per week.
- Yearly Premium: $39.99 per year, auto-renewing. No free trial.
- Lifetime Premium: $59.99 one-time purchase, non-renewing. Permanent access to all Premium features tied to your Apple ID.
Premium features include but are not limited to: unlimited practice tests, full practice tests in real exam format, AI Tutor (Scout) access, complete Learn Mode with all lessons, detailed analytics and progress tracking, category-specific practice, and weak areas practice.
Existing Lifetime and Legacy Weekly Purchasers
Users who purchased a previous Lifetime offering or who hold an active legacy Weekly subscription from a prior pricing tier retain access to all Premium features at no additional cost. This access is tied to the Apple ID used for the original purchase and can be restored on any device by using the “Restore Purchases” feature within the App.
Auto-Renewal and Cancellation
- All payments are processed through Apple’s In-App Purchase system
- Auto-renewing subscriptions automatically renew for the same period at the same price unless cancelled at least 24 hours before the end of the current billing period
- Your Apple account will be charged within 24 hours prior to the end of the current period upon confirmation of purchase
- After the free trial, your account will be charged $7.99 weekly
- Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription
- Lifetime Premium is a one-time, non-renewing purchase and does not auto-renew
- Prices are in U.S. dollars and may change with 30 days’ notice to active subscribers
You may cancel your subscription at any time through your Apple account settings (Settings > [Your Name] > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of your paid period.
Refunds
All purchases and subscriptions are processed through Apple. Refund requests must be submitted directly to Apple through their standard refund process. TSI does not process refunds directly. Contact Apple Support for refund inquiries. The exception is the Pass Guarantee program described below, which is administered through Apple’s standard refund process but reviewed for eligibility by TSI.
Pass Guarantee
Premium subscribers and Lifetime Premium buyers who fail their official state DMV/DHSMV permit knowledge test on the first attempt may request a refund of their most recent payment, subject to all of the following conditions:
- In-app eligibility: Before the failed test, you must have (a) completed the diagnostic assessment, (b) completed at least five (5) full practice tests in the App, (c) scored 80% or higher on at least three (3) of those practice tests, and (d) used the App on at least seven (7) distinct calendar days.
- Claim window: Subscription buyers must submit the claim within 30 days of the failure date. Lifetime Premium buyers must submit the claim within 60 days of the failure date.
- Proof: A photo or scan of the official DMV/DHSMV failure notice (showing date and outcome) emailed to support@trafficsafetyinstitute.com.
- Refund mechanism: Approved refunds are processed exclusively via Apple’s App Store refund process. We do not issue cash refunds, off-platform refunds, or in-app credits.
- Limit: One Pass Guarantee claim per Apple ID account per lifetime.
TSI reserves the right to validate claims against in-app analytics, request additional information, and decline claims that do not meet all eligibility conditions above.
5. User Content and Conduct
User-Generated Content
When using social features (leaderboard, challenges, profile), you may create content such as usernames and shared achievements. You grant TSI a worldwide, royalty-free license to use, display, and distribute this content in connection with the App.
Prohibited Conduct
You agree NOT to:
- Post offensive, harassing, or inappropriate content
- Impersonate others or misrepresent your identity
- Cheat or manipulate leaderboard rankings
- Spam or harass other users
- Violate any applicable laws or regulations
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
6. Intellectual Property
Our Content
All content in the App, including questions, lessons, explanations, design, graphics, logos, and software, is owned by TSI or its licensors and protected by copyright, trademark, and other intellectual property laws.
State Handbook Content
The practice questions are based on publicly available driver handbook information from the applicable state’s department of motor vehicles or equivalent agency. We do not claim ownership of official state content but own our unique presentation, explanations, and study system.
Trademarks
“Permit Prep,” “CA DMV Permit Prep,” “FL Class E Exam Prep,” and associated logos are trademarks of TSI. You may not use our trademarks without prior written permission. Any future state-specific app names published by TSI are also trademarks of TSI.
7. AI Tutor Feature (Premium)
The AI Tutor feature (“Scout”) uses artificial intelligence to provide explanations and study assistance. By using this feature:
- You acknowledge that AI responses are generated automatically and may contain errors
- You understand that the AI Tutor is subject to usage limits that may vary based on your subscription tier and system capacity
- You agree that AI Tutor is limited to questions related to driver permit or license preparation for the applicable state
- We are not responsible for the accuracy of AI-generated content
- AI Tutor does not provide legal advice — for official guidance, consult your state’s department of motor vehicles or a licensed driving instructor
8. Educational Purpose and Disclaimers
Not a Pass Guarantee
The App is designed to help you study for your state’s driver permit or license examination. Although we offer the Pass Guarantee refund program described in Section 4, the program is a conditional refund offer, not a warranty that you will pass. Specifically:
- WE DO NOT GUARANTEE THAT YOU WILL PASS ANY STATE’S OFFICIAL EXAMINATION
- The App is for educational and study purposes only
- Official state examinations may include questions not covered in our App
- You are responsible for meeting all state requirements for testing
- The Pass Guarantee program is subject to the eligibility and proof requirements in Section 4
Use at Your Own Risk
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, reliability, or completeness of content
- Warranties of uninterrupted or error-free operation
No Professional Advice
The App does not constitute professional driving instruction or legal advice. For official guidance, consult your state’s department of motor vehicles or a licensed driving instructor.
9. Limitation of Liability
To the maximum extent permitted by law:
TSI SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Failure to pass any state’s driver permit or license examination
- Any damages arising from your use or inability to use the App
- Any third-party content or conduct on the App
MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid to us in the 12 months before the claim, or $100, whichever is less.
Some jurisdictions do not allow limitations on implied warranties or liability, so some limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless TSI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your user-generated content
11. Updates and Changes
App Updates
We may release updates to improve features, fix bugs, or add new functionality. You are responsible for downloading updates. Some features may require the latest version.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you by:
- Posting updated Terms in the App
- Updating the “Last Updated” date
- Sending a notification for material changes
Continued use after changes constitutes acceptance of the new Terms.
Changes to Features or Pricing
We may modify, suspend, or discontinue any feature at any time without liability. We may change subscription prices with 30 days’ notice to active subscribers.
12. Termination
By You
You may stop using the App at any time by deleting it from your device. To delete your account and data, contact support@trafficsafetyinstitute.com.
By Us
We may suspend or terminate your access to the App immediately, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse of other users
- Non-payment of subscription fees
- Any reason at our sole discretion
Upon termination:
- Your license to use the App ends immediately
- We may delete your account and data
- Outstanding subscription fees remain due
- Sections that should survive termination will remain in effect
13. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration Agreement
READ THIS CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS
Any dispute arising from these Terms or the App shall be resolved through binding arbitration, except:
- Small claims court disputes (under $10,000)
- Intellectual property disputes
- Injunctive relief requests
Arbitration Rules:
- Administered by JAMS under its Streamlined Arbitration Rules
- Single arbitrator appointed per JAMS rules
- Arbitration located in Los Angeles County, California or via video conference
- Each party bears own costs unless awarded by arbitrator
- Discovery limited to what arbitrator allows
CLASS ACTION WAIVER: YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER OR REPRESENTATIVE. THERE WILL BE NO CLASS ARBITRATIONS OR CLASS ACTIONS.
Opt-Out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@trafficsafetyinstitute.com with “Arbitration Opt-Out” in the subject line.
14. State-Specific Terms
The App provides educational content specific to the state indicated by the particular application you have downloaded. Each version of the App contains practice questions, study materials, and reference content tailored to that specific state’s driver permit or license examination requirements.
By using the App, you acknowledge and agree that:
- The content is designed specifically for the state indicated in the App’s name and description
- TSI is not responsible if you use a state-specific App to prepare for a different state’s examination
- Driving laws, rules, and examination requirements vary by state and may change at any time
- While we make reasonable efforts to keep content current, we do not guarantee that all content reflects the most recent changes to any state’s laws or examination format
- You are solely responsible for verifying that you are using the correct state-specific version of the App
- The App is not endorsed by, affiliated with, or connected to any governmental agency
15. Third-Party Services
The App integrates with:
- Apple App Store / StoreKit: Subject to Apple’s Terms of Service. Used for app distribution, in-app purchases, and subscription management.
- Firebase (Google): Subject to Google’s Terms of Service. Used for crash reporting, performance monitoring, and analytics.
- Anthropic Claude API: Subject to Anthropic’s Terms of Service. Used to power the AI Tutor feature.
- CleverTap: Subject to CleverTap’s Terms of Service. Used for push notifications, in-app messaging, and user engagement analytics.
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
16. Export Controls
The App may be subject to U.S. export control laws. You agree to comply with all applicable export and import laws and regulations.
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.
18. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and TSI regarding the App and supersede any prior agreements.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
