These Terms of Service (“Terms”) govern your use of the CA DMV Permit Prep mobile application (“App”) operated by Prat City LLC DBA Traffic Safety Institute (“TSI”, “we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 15 years old to use this App. By using the App, you represent and warrant that:
- You are at least 15 years of age
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
If you are under 18, you should review these Terms with a parent or guardian.
2. License to Use the App
Subject to your compliance with these Terms, TSI grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use in preparing for the California DMV permit test.
Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, sell, or sublicense the App
- Remove or alter any proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Share your account credentials with others
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems (bots, scrapers) to access the App
3. Account Creation
Optional Account
The core study features of the App do not require an account. You may use practice quizzes, study modes, and track local progress without registration.
Required for Social Features
To access leaderboard, challenges, and social features, you must create an account using Apple Sign-In. When creating an account, you must:
- Provide accurate and complete information
- Choose a username that is not offensive, impersonating, or infringing
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use
You are responsible for all activities under your account.
4. Subscriptions and Payments
Free Features
The App offers limited free access including:
- 50 practice questions
- 1 full practice test
- Basic study features
Paid Subscriptions
We offer the following paid subscription tiers:
- Basic: $4.99/month or $9.99 one-time purchase – All 200 questions, unlimited practice tests, advanced statistics
- Premium: $9.99/month or $79.99/year – All Basic features plus AI Tutor access
Payment Terms
- All payments are processed through Apple’s In-App Purchase system
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your Apple account will be charged at confirmation of purchase
- Prices are in U.S. dollars and may change with notice
- No refunds for partial subscription periods
Cancellation
You may cancel your subscription anytime through your Apple account settings. Cancellation takes effect at the end of the current billing period.
Refunds
All sales are final. Refund requests are handled through Apple’s refund policy. Contact Apple Support for refund inquiries.
5. User Content and Conduct
User-Generated Content
When using social features (leaderboard, challenges, profile), you may create content such as usernames and shared achievements. You grant TSI a worldwide, royalty-free license to use, display, and distribute this content in connection with the App.
Prohibited Conduct
You agree NOT to:
- Post offensive, harassing, or inappropriate content
- Impersonate others or misrepresent your identity
- Cheat or manipulate leaderboard rankings
- Spam or harass other users
- Violate any applicable laws or regulations
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
6. Intellectual Property
Our Content
All content in the App, including questions, lessons, explanations, design, graphics, logos, and software, is owned by TSI or its licensors and protected by copyright, trademark, and other intellectual property laws.
DMV Questions
The practice questions are based on publicly available California DMV test information and California Driver Handbook. We do not claim ownership of official DMV content but own our unique presentation, explanations, and study system.
Trademarks
“CA DMV Permit Prep” and associated logos are trademarks of TSI. You may not use our trademarks without prior written permission.
7. AI Tutor Feature (Premium)
The AI Tutor feature uses Anthropic’s Claude API to provide explanations and study assistance. By using this feature:
- You acknowledge that AI responses are generated automatically and may contain errors
- You agree that AI conversations are subject to Anthropic’s privacy policy
- You understand that AI Tutor is limited to 50 questions per day
- We are not responsible for the accuracy of AI-generated content
8. Educational Purpose and Disclaimers
Not a Guarantee
The App is designed to help you study for the California DMV permit test. However:
- WE DO NOT GUARANTEE THAT YOU WILL PASS THE DMV TEST
- The App is for educational and study purposes only
- Official DMV tests may include questions not covered in our App
- You are responsible for meeting all DMV requirements for testing
Use at Your Own Risk
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, reliability, or completeness of content
- Warranties of uninterrupted or error-free operation
No Professional Advice
The App does not constitute professional driving instruction or legal advice. For official guidance, consult the California DMV or a licensed driving instructor.
9. Limitation of Liability
To the maximum extent permitted by law:
TSI SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Failure to pass the DMV test
- Any damages arising from your use or inability to use the App
- Any third-party content or conduct on the App
MAXIMUM LIABILITY:
Our total liability shall not exceed the amount you paid to us in the 12 months before the claim, or $100, whichever is less.
Some jurisdictions do not allow limitations on implied warranties or liability, so some limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless TSI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your user-generated content
11. Updates and Changes
App Updates
We may release updates to improve features, fix bugs, or add new functionality. You are responsible for downloading updates. Some features may require the latest version.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you by:
- Posting updated Terms in the App
- Updating the “Last Updated” date
- Sending a notification for material changes
Continued use after changes constitutes acceptance of the new Terms.
Changes to Features or Pricing
We may modify, suspend, or discontinue any feature at any time without liability. We may change subscription prices with 30 days’ notice to active subscribers.
12. Termination
By You
You may stop using the App at any time by deleting it from your device. To delete your account and data, contact support@trafficsafetyinstitute.com.
By Us
We may suspend or terminate your access to the App immediately, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse of other users
- Non-payment of subscription fees
- Any reason at our sole discretion
Upon termination:
- Your license to use the App ends immediately
- We may delete your account and data
- Outstanding subscription fees remain due
- Sections that should survive termination will remain in effect
13. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration Agreement
READ THIS CAREFULLY – IT AFFECTS YOUR LEGAL RIGHTS
Any dispute arising from these Terms or the App shall be resolved through binding arbitration, except:
- Small claims court disputes (under $10,000)
- Intellectual property disputes
- Injunctive relief requests
Arbitration Rules:
- Administered by JAMS under its Streamlined Arbitration Rules
- Single arbitrator appointed per JAMS rules
- Arbitration located in Los Angeles County, California or via video conference
- Each party bears own costs unless awarded by arbitrator
- Discovery limited to what arbitrator allows
CLASS ACTION WAIVER:
YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER OR REPRESENTATIVE. THERE WILL BE NO CLASS ARBITRATIONS OR CLASS ACTIONS.
Opt-Out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@trafficsafetyinstitute.com with “Arbitration Opt-Out” in the subject line.
14. California-Specific Terms
This App is designed specifically for California residents preparing for the California DMV permit test. Questions and content are based on California driving laws and regulations.
If you use this App to prepare for driving tests in other states, we are not responsible for differences in state requirements or content accuracy.
15. Third-Party Services
The App integrates with:
- Apple App Store: Subject to Apple’s Terms of Service
- Firebase (Google): Subject to Google’s Terms of Service
- Anthropic Claude API: Subject to Anthropic’s Terms of Service
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
16. Export Controls
The App may be subject to U.S. export control laws. You agree to comply with all applicable export and import laws and regulations.
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.
18. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and TSI regarding the App and supersede any prior agreements.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
